The security of your personal data is important to us. This privacy policy discloses information regarding the data we process, how we process them and for what purposes, and the rights you may have regarding your data.

WHO ARE WE?

The personal data controller is JOBBY TALENT DATA S.R.L., a limited liability company, with the registered office in Târgu Mureș 540331, 2nd floor, St. Brăila 2-4, Romania, registered with the Trade Register Office from Mures under number J26/1981/2019, sole identification number 41811875 ("the Company").

This Privacy Policy applies to the personal data we collect about you when you use our Website, and when you use the services offered on the Website (uploading CVs, uploading photos / video presentations, posting job ads) or contact us through our existing social media pages, such as Facebook, Youtube, LinkedIn.

DATA PROCESSED AND THEIR ORIGIN

1. Data provided by you

Most of the data we process about you is provided by you directly, when you create an account on our Website, when you contact us through the contact form available on the Website or when you call on the services offered on the Website. Thus, we process the following categories of data:

  • Identification and contact details : surname, first name, email, telephone number, address, your capacity within the company (in the case of the Employer’s account);

  • Personal data : date and place of birth, nationality, marital status, profile photo, other data provided by filling in the "Personal Information" field attached to the User Account, etc .

  • Financial data: current salary, desired salary, etc .

  • Data from the CV uploaded / created on the Website: data on your professional experience (data on previous employers, termination of the individual contract at your last job and job responsibilities, special projects, etc.), your picture, if you have voluntarily provided such a picture (eg including in your CV or other documents provided by you), affiliations to various professional, cultural or other groups / entities / clubs if such data is included in the CV or other documents provided by you, data related to the known foreign languages, data on your professional training (diplomas, certificates, internships, special training, etc.), information on holding a work permit and / or on your residing in the European Economic Area (EEA), information on holding a driver's license, any other information provided as part of the CV or of the employment application, the results of the evaluation tests carried out by the evaluation centers, if they were provided by you in your CV and the other documents provided by you, any other data provided by you through the site;

  • Content you generate through our Website, respectively the messages you send to us through the contact form existing on the site or by email, content to the feedback messages for the services offered by the Website, content you generate through of our existing pages on social networks, such as Facebook, Youtube, LinkedIn. When you "like" our page or our posts, when you send us messages or when you post comments, data such as your username, image / picture or message content will be processed. It is possible that the social networks allow us to automatically access certain information they collect about you (eg content that you have viewed or have "liked" or information about the ad videos you viewed, etc.).

2. Data we process automatically when you access the website

When you access the Website, we use Google Analytics to collect information about your interaction with the Website. This information allows us to give you access to our Website and to receive information about how visitors use our Website, so that we can improve our services. Thus, we process the following categories of data:

  • Log-in data - like most Internet pages, we use data that the Internet browser or mobile device typically supply, such as browser type, IP address, operating system, or access date and time.

  • Usage data - we process data on how to use the Website, to find information such as the number of visitors on various pages on the Website, whether or not you updated your CV, the latest CV update - if you applied for a job, etc

  • Data provided by cookies and other technologies - For more information about the cookies, please refer to the Cookie Policy.

PURPOSE AND BASIS OF DATA PROCESSING

We process your data only when the law allows us and only for the purposes mentioned above or for other purposes, if they are compatible with the initial purposes. Most commonly, we will use your data in the following situations:

1. To allow you to create your account on the Website

The Company’s processing operations for this purpose, according to the General Data Protection Regulation, is based on your consent. You may at any time withdraw your expressed consent when creating the account on the Website by deleting your account - any data that was provided to the Company at the time of creating the account will be automatically deleted.

By way of exception, if your CV was made public, the Employers who had access to your CV had the opportunity to download or transmit your personal data on their own storage media. In this case, even this the Company erases your data from the database, the Employers will continue to be able to access your data if they have downloaded, copied or extracted it from the database available on the Website. In their capacity as operators, the Employers are independently responsible for how they use your personal data they access through the Website.

2. To respond to your requests when you contact us through the contact form available on the Website without having an account on the Website

Such processing will be based on your express consent to process your data for this purpose.

3. Use of services by Job Applicants

We process Job Applicants' personal data to allow them to use the Services (such as creating a CV, applying for a job, viewing employment ads, contacting Employers, receiving job posts and alerts of recruitment published by Employers, receive job suggestions according to their preferences / qualities etc.)

Legal basis: art. 6 (1) (b) GDPR - conclusion and execution of the contract.

Equally, the Website may be accessed by the Employer from abroad, including outside the European Economic Area, to jurisdictions that have not been granted adequate protection. If you apply for a job published by such an Employer, you data may be transferred to such a jurisdiction, and the legal basis for the transfer is your express consent at the time you applied to that position.

We can also use a series of data you provide to us to provide job suggestions or suggestions to complete your CV. We also use the data we receive from Job Applicants / Employers to create filtering facilities for the Employers / Job Applicants on various criteria of interest of Job Applicants / specific recruitment ads posted by the Employer.

Legal basis: art. 6 (1) (f) GDPR - legitimate interest. We have a legitimate interest to improve our services and provide suggestions / tips to Job Applicants to maximize the success of our services. At the same time, we want to provide a more efficient indicator search service for Employers.

4. Use of services by Employers

We process personal data for the purpose of managing the contractual or pre-contractual relationship with the Employers.

In case of Employers (authorized individuals) the legal basis is: art. 6 (1) (b) GDPR - conclusion and execution of the contract or performing the pre-contractual formalities. In the case of personal data of the representatives of the Employers, the legal basis is art. 6 (1) (f) GDPR - legitimate interest.

We have a legitimate interest in properly conducting our contractual relationships with our clients legal entities. The rights and interests of individuals (i.e. the representatives of the Employers) are not prejudiced, since from the client, legal entity, perspective, the processing is required in the context of the working / collaboration relationships they have with the individuals whose data are provided / associated to the Employer account.

5. User relations management and support

We process personal data for the purpose of managing relationships with the Website’s Users, for example, when they contact us with various questions or requests regarding the Website functionality, malfunctions or errors. Legal basis: art. 6 (1) (f) GDPR - legitimate interest - is our interest in providing adequate services to all Users.

6. Provision of services - related communications

Users may receive various communications from the Company regarding the provision of services (if the CV has been viewed by any Employer, jobs saved that expire, alerts regarding the need to update the CV, alerts regarding scheduled interviews, etc.). We process these data based on our legitimate interest, art. 6 (1) (f) GDPR. We believe that our legitimate interest does not prejudice to the rights and interests of the data subjects, since communications are closely linked to the provision of the requested services. We provide the possibility for Users to dezactivate these communications at any time from the User account settings.

7. Connection through social networks

Job Applicants can log in or create an account through Facebook / Google / LinkedIn which allows them to login through their related accounts. When Job Applicants use this facility, we use the public data (eg name, first name, email address, phone number). The use of this data is necessary for the creation of the User account.

We have also implemented various mechanisms of interlinking with the social pages, such as Facebook and Youtube, so that you can access the content posted by us on our accounts associated with the social network accounts.

If you access the content posted or comment on the social networks, a set of public data from your profile will be transmitted to us by the social network operators.

Legal basis: art. 6 (1) (b) of the GDPR, the conclusion and execution of the contract (in the case of Facebook / Google / LinkedIn login data) or art. 6 (1) (a) GDPR - consent (in other situations).

8. For organizing promotional campaigns

From time to time, we will organize campaigns to promote our products and services by carrying out various marketing operations, such as offering promotional products or services.

Depending on the campaign time, it may be possible to process your data, such as first and last names, in order to run the campaign under appropriate conditions.

Such processing will be based on our legitimate interest in promoting our commercial activity and we will not process data that exceed the purpose of processing.

9. For sending commercial communications

Also, any visitor of the Website may opt to receive newsletters by email regarding our products and services, in which case we will process your data based on your express consent to subscribe to such newsletters and to have your data processed for this purpose

You can unsubscribe at any time from receiving such commercial communications by simply accessing the unsubscribe button included in each of our commercial emails.

WITH WHOM WE SHARE YOUR DATA

Your personal data will be disclosed to the Company’s employees, the IT department and the legal representatives of the Company, only to the extent necessary for the activities and purposes for which we process your personal data.

We may disclose your personal data to (i) the entities and / or proxies (from the EEA or from third countries) involved in the provision of services including the supply of commercial communications (such as data center providers, payment service providers for various payment facilities on the Website; (ii) Employers, including those outside the EEA. Also, your personal data may be disclosed to third party cookie providers and similar technologies as described in the Cookie Policy.

Public and law enforcement authorities

Central or local public authorities, and police agencies and other public agencies or institutions may sometimes ask us to provide them with various data, including data related to you. These requests may be for certain purposes as: checking the fulfillment of our fiscal obligations, investigating complaints, and preventing or detecting crimes, frauds or money laundering operations.

Publicly available content

The content you generate through our social network pages, such as Facebook, Youtube, LinkedIn, in situations such as "like" our page or our posts or when you post comments, data such as your username, image / the picture or place where you are will be available and will be able to be viewed by anyone who visits the pages of the Company on the social networks. You control at any time the personal data we may access through the existing settings on the social network in question.

Any data transmission under the above conditions is done in precise situations, limited to the purpose of the processing and in accordance with the personal data processing provisions.

HOW LONG DO WE STORE YOUR PERSONAL DATA

We keep your personal data as long as it is required to meet the purposes for which they were collected.

Generally, the data related to the job Applicants is stored as long as they have an user account on the Website. Personal data will be deleted if the Job Applicant requests the desactivation and deletion of the account, or after at least 5 years from the date the Job Applicants become inactive (ie from the date of the last interaction on the Website).

The date related to the Employers (authorized individuals and representatives of the legal entities) will be kept throughout the contractual relations with the Employer plus the entire period provided by the law for archiving and keeping the financial-accounting documents.

The data related to cookies and similar technologies are kept based on the specific settings, the storage term can be between the duration of the browsing session (for session cookies) and a duration of up to 2 years (for analysis cookies).

WHAT ARE YOUR RIGHTS

Right of access - you have the right, at any time, to know what data we process about you, and information about how we process your data.

Right to rectification - if you find that the data we have about you are incorrect or incomplete, you have the right, at any time, to ask us to rectify, or to complete, the inaccurate or incomplete data concerning you.

Right to erasure (‘right to be forgotten’) - you have the right to ask us to erase the personal data we have about you. We mention, however, that the right to be forgotten is not an absolute right, and applies to certain situations only. So, before we respond to your request, we will analyze it and inform you about the result.

Right to restriction of processing - in certain circumstances, you may ask us to restrict the way we process your data. You have the right to request processing restriction when you have a specific reason to want the restriction. This can be, for example, because you dispute the accuracy of the data we process about you or challenge the way we processed it.

Right to data portability - in certain situations, you may ask us to transmit the data belonging to you to an entity indicated by you.

You have the right to object to the processing of data concerning you

At any time, you have the right to object to the processing of your personal data based on a legitimate interest, for reasons related to your particular situation. The exercise of the right of opposition will not automatically cause cessation of processing. Review of your reasons to oppose, against the reasons that could justify further processing shall be made. You will receive the result of our analysis and the measures to be taken as a result of the analysis performed.

When processing is based on your express consent, you will have the right to withdraw your consent at any time regarding the processing of the data concerning you.

TO EXERCISE ANY OF THE ABOVE MENTIONED RIGHTS, including the right of access to data, the right to object or withdraw of the consent, as the case may be, the right to rectification, deletion or restriction of processing, please contact us using the forms on the Website or through a request sent to our registered office.

YOU HAVE THE RIGHT TO FILE A COMPLAINT WITH A SUPERVISORY AUTHORITY
